THELATINBROTHERS asserts copyright and all other intellectual property rights in this site and code used to created it. All materials, including images, illustrations, designs, icons, photographs and written and other materials that appear on the THELATINBROTHERS site are copyrights.

THELATINBROTHERS is the owner of the THELATINBROTHERS trademark, Other trademarks made available through this site, including logos, slogans, color schemes and designs, are licensed for use by THELATINBROTHERS.

Registration And Security

Use of THELATINBROTHERS website service requires that you register and/or create an account or use the site as a guest. To register and create an account, you must select an account designation and password and provide certain personal information (the "Personal Information"). In consideration of the use of the THELATINBROTHERS website services, you agree to provide true, accurate, current and complete information about yourself as prompted by the registration form, and maintain and promptly update the personal information you provide to keep it true, accurate, current and complete.

If you provide any information that is untrue, inaccurate, not current or incomplete, or THELATINBROTHERS has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, THELATINBROTHERS has the right to refuse any and all current or future use of the site and/or business with you.

You agree to (a) immediately notify THELATINBROTHERS of any known or suspected unauthorized use(s) of your password or account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password; and ensure that you exit from your account at the end of each session. THELATINBROTHERS will not be liable for any injury, loss or damage of any kind arising from or relating to your failure to comply with the above or for any acts or omissions by you or someone else using your account and/or password.

Alcohol Delivery Rules and Restrictions

In Switzerland, the purchase of alcohol is prohibited to minors. The customer confirms by completing a purchase through the site, that he is at least 18 years old and that he has the required legal age under his applicable jurisdiction to purchase alcohol. THELATINBROTHERS declines any responsability whatsoever in case of untrue, inaccurate, not current or incomplete information provided by you in this context.

User conduct

You agree that your use of the site and/or services on the site is subject to all applicable Swiss laws and regulations. You also agree:

  • not to use the site to purchase alcohol unless you and the alcohol recipient are 18 or older and have the legal age required in the applicable jurisdiction to you and the recipient to make such a purchase.

  • not to access the site or services using a third-party's account/registration without the express consent of the account holder

  • not to use the site for illegal purposes

  • not to commit any acts of infringement on the site or with respect to content on the site

  • not to use the site to engage in commercial activities apart from the use intended by THELATINBROTHERS

  • not to copy any content for republication in print or online

  • not to attempt to gain unauthorized access to other computer systems from or through the site

  • not to interfere with another person's use and enjoyment of the site or another entity's use and enjoyment of the site

  • not to upload or transmit viruses or other harmful, disruptive or destructive files and/or

  • not to disrupt, interfere with, or otherwise harm or violate the security of the site, or any services, system resources, accounts, passwords, servers or networks connected to or accessible through the site or affiliated or linked site (including those of our partner stores)

Product Sales

By placing an order via THELATINBROTHERS site, a customer makes a binding offer for a contract of sale. THELATINBROTHERS sends an order confirmation via e-mail to the customer. 
However, it is always subject to the condition that the delivery is possible or that the price indicated (by the manufacturer, supplier or by THELATINBROTHERS) is free from error.

The order confirmation is not an acceptance of the offer, but only acknowledges that the order was received. The offer is only accepted when THELATINBROTHERS confirms that sale in a second e-mail. THELATINBROTHERS cannot guarantee the continued availability of any products on its site.

Information, drawings, figures, technical data, specifications of weight, measurements and services contained on the website, brochures, catalogues, newsletters, ads, or price lists are purely informational. THELATINBROTHERS cannot guarantee the correctness of this information, and there may be a difference between the information described above and the information in an sale confirmation email.

THELATINBROTHERS reserves the right to reject orders for any reason or no reason. If THELATINBROTHERS rejects an order, it will notify the customer.

THELATINBROTHERS performance of an order is completed when the shipment provider completes delivery to the customer's address, according to the records of the shipment provider. If there is an interruption of delivery, and THELATINBROTHERS cannot replace the order in a reasonable amount of time, THELATINBROTHERS will notify the customer immediately.

Delivery & Shipment

THELATINBROTHERS warrants that it will ship orders within three working days after orders are placed. Normally, goods are shipped within the next day of the placed order and typical delivery times for Swiss recipients are 1-3 working days, but in certain circumstances shipment and delivery can take several weeks. Customers and THELATINBROTHERS may separately agree to more specific delivery times and terms in a separate writing or agreement (such as a request for express shipping). 

THELATINBROTHERS will make delivery using a shipment service provider of its choosing. The customer must pay standard shipping costs which may depend on order value and shipping destinations. Shipping costs are displayed at checkout.

Prices

All prices found on THELATINBROTHERS site are final, and may change from time to time. Shipping and handling are billed and shown separately at checkout (or on invoices, if applicable). The shipping address and order amount may affect certain costs, and sales taxes may apply to some orders.

For customers ordering from outside Switzerland and Liechtenstein, all product prices are net of local taxes and fees. If, according to applicable law, the goods are subject to sales taxes, import duties, import brokerage fees, or other taxes or fees in the recipient's country, then the customer has the sole responsibility to pay these taxes and fees. 

Customers must pay the purchase price, applicable sales taxes, and shipping and handling charges immediately upon placing an order.

Payment

Customers may choose to pay by PayPal. THELATINBROTHERS reserves the right to limit the method of payment chosen by the customer depending on order value, shipment destination, or other objective criteria.

If the customer selects a payment method or provides payment information that makes it impossible or impractical for THELATINBROTHERS to receive payment (for example, the customer provided incorrect payment information) through no fault of THELATINBROTHERS ‘s own, the customer agrees that THELATINBROTHERS may add an additional charge to the order to recoup costs associated with processing or attempting to process the impossible or impractical transaction.

THELATINBROTHERS may sub-contract third parties to process payment. If the customer fails to pay, THELATINBROTHERS may assign its claims to a debt collection agency and transfer the Personal Data required for collecting payment to these third parties.

Disclaimers

THELATINBROTHERS provides the site and service on an "as is" and "as available" basis. THELATINBROTHERS does not represent or warrant that the site and service or its use: (i) will be uninterrupted, timely, safe, or secure, (ii) will be free of inaccuracies, errors, or vulnerabilities, (iii) will meet your expectations or requirements, or (iv) will operate in the configuration or with the hardware or software you use. THELATINBROTHERS hereby disclaims any and all express or implied warranties, including without limitation, warranties of fitness for a particular purpose, merchantability, and non-infringement to the fullest extent of the law, except to the extent that this agreement provides otherwise.  
You agree that THELATINBROTHERS has no responsibility for any damages suffered by you in connection with the site, the service and products, and that use of the site, the service and products (including all content, data or software distributed by, downloaded, or accessed from or through the site and service) is at your sole risk. You understand and agree that you will be solely responsible for any damage to your person, your business or your computer system or any loss of data that results from your actions and your use of the site, the service and the products. THELATINBROTHERS does not control or endorse in any respect any information, products, or services offered by third parties through the site and service, and is not responsible for any possible representations and warranties these third parties may make.

THELATINBROTHERS may use subcontractors or third parties to provide certain elements of its site and service. You agree that THELATINBROTHERS will not be liable to you in any way for your use of these services.

Contests

The competitions organized by THELATINBROTHERS are designed to offer everyone a fair chance to win. We want every participant to get the most out of the experience. Here are the conditions of participation in our contests:

  • Eligibility

    The contests organized by THELATINBROTHERS are open to anyone over 18. Only one entry per person and per game is permitted to ensure fairness.

  • Eligible residence

    Currently, only participants who have played from Switzerland and Liechtenstein will be eligible for the draw.

  • Contest questions

    The heart of our competition lies in the questions about the products in our online store and their stories. The questions are designed to be both informative and fun, allowing you to learn more about Latin American culture.

  • Form submission

    All contest forms must be duly completed and submitted before the contest closing date to be taken into account. Participants are encouraged to respect the specified deadlines.

  • Determining the winner

    Once the contest is over, all participants who have correctly answered all the questions will be entered into a prize draw. We will ensure that the draw procedure is fair and transparent.

  • Announcement of winner

    The winner will be personally notified by e-mail. Be sure to keep an eye on your inbox! The value of the prize cannot be converted into cash.

  • Claiming the prize

    The winner is invited to contact THELATINBROTHERS within thirty days of receipt of the notification e-mail to arrange delivery of the prize. If the winner does not contact THELATINBROTHERS within this period, the prize will lapse and may be awarded again in a future competition.

  • Compliance with the rules

    Any participation or attempted participation that contravenes the rules of the contest, in particular by electronic, computerized or automated means, will be automatically rejected. We are committed to the fairness and integrity of our contests.

  • Data confidentiality

    Participants' personal data will be treated as confidential. THELATINBROTHERS may use them for marketing purposes, in compliance with applicable data protection laws.

  • Legal remedies

    Any legal action relating to our competitions is excluded. We favour a friendly approach to resolving any problems or concerns.

Data Protection

THELATINBROTHERS collects and uses your information according to its Privacy Policy. You acknowledge that you are responsible for the securing your own information (including passwords), keeping your sensitive information confidential, and taking responsibility for actions taken in connection with your user account.

Applicable Law

These Terms of Conditions and the Privacy Policy are governed exclusively by Swiss law.
